Data we collect

• Account data: Email address, username, country (required to create an account)
• Listing data: Card details, prices, descriptions you submit
• Transaction data: Purchase/sale records, shipping method, buyer ratings. Payment info is handled by Stripe (they are the data processor — we never see card numbers)
• Technical data: IP address, browser type (in server logs, auto-deleted after 30 days)
• Communications: Messages between members via our platform, including trade conversations
• Collection and trade data: Cards in your collection, your Wants (with optional target prices), trades (offers, the shipping address you exchange with your trade partner, tracking numbers) and your trade reputation
• Public profile and activity: Username, country, optional avatar, bio and links, your community posts, ratings and trade reputation. Your collection showcase, trade binder and Wants are visible to others only where you make them public
• Notification settings: Which emails you receive (order updates, Want price alerts, trade updates, the optional weekly digest) — change them under Settings → Notifications
• Card scanner photos: If you use the card scanner, the photo you submit is processed to identify the card (see "Third parties" — Anthropic). When you confirm a match, we store a numerical image fingerprint (an "embedding") of the photo to improve future matching — not the photo itself. Scanner photos you attach to a listing as product photos are stored like any other listing image.

Your rights

Under GDPR you have the right to: access your data, correct inaccurate data, delete your account and data, export your data (portability), restrict processing, and object to processing. Email privacy@foilmarket.eu to exercise these rights. We respond within 30 days.

Data retention

Account data: retained while your account is active + 30 days after deletion. Transaction records: 7 years (Austrian commercial law requirement, UGB §212). Messages: 2 years. Trade records: kept while your account exists for reputation purposes, anonymised when you delete your account.

Third parties

• Supabase (EU servers): Database and authentication. GDPR DPA in place.
• Stripe: Payment processing. Their privacy policy applies to payment data. Stripe.js runs on our pages for fraud prevention and may set its own cookies (see Cookie Policy).
• Hostinger: Web hosting. EU servers used.
• Google Analytics 4: Anonymous traffic analytics, only if you accept optional cookies. Data may be processed by Google; any transfer to the US is covered by the EU–US Data Privacy Framework. Runs in consent-denied, cookieless mode until you opt in.
• Anthropic (Claude): Powers the card scanner. Photos you submit for scanning are sent to Anthropic's API to read the card's printed text and are not used by Anthropic to train models. Any transfer to the US is covered by the EU–US Data Privacy Framework.
• Titan / Hostinger (email): Sends transactional emails (order updates, notifications) from our own domain via SMTP.
• Scrydex: Licensed card catalogue and market-price data. No personal data is shared with Scrydex.
• Cardmarket: Published daily price guide and product catalogue (EUR prices). No personal data is shared with Cardmarket.
• jsDelivr (CDN): Delivers open-source scripts (image helpers, the in-browser card-matching library). They receive your IP address when those files load.
• Hugging Face: The scanner's in-browser matching model is downloaded from Hugging Face's CDN on first use. For that step your photo never leaves your browser.
• Discord: New listings (card, price, seller username and link) are announced automatically in FoilMarket's public Discord server.

Terms of Service

1. Platform description

FoilMarket.eu is a peer-to-peer platform for the Pokémon Trading Card Game: a marketplace for single cards (raw or graded) and sealed products, a Trading Hub for card-for-card trades between members, a collection tracker, price tools (FoilValue, FoilGuess) and a Community feed. We connect members; we are not a party to any sale or trade between users. Digital-only cards (e.g. Pokémon TCG Pocket) cannot be listed or traded.

2. Account requirements

You must be 18 or older (or 16 with parental consent under Austrian law). One account per person. You are responsible for your account security.

3. Seller obligations

• Cards must be accurately described and graded honestly
• Condition must match: NM = no visible wear, LP = minor edge wear only, PL = clear play wear
• Ship within 3 business days of payment confirmation
• Sellers must set fair rates in their shipping profile; FoilMarket automatically applies the correct tier (economy, tracked, parcel or insured) to each order by its value and contents
• When an order ships tracked, parcel or insured, the seller must provide a valid tracking number
• Graded cards (PSA, BGS, CGC and others): the grading company, grade and certificate number you enter must match the slab exactly; the grade is shown in place of a condition
• Sealed products must be factory sealed and unopened; resealed or tampered items are prohibited
• Prohibited: counterfeits, proxy cards, damaged cards listed as NM, items not matching photos, resealed products, digital-only cards

4. Fees

Listing is free and buyers pay no platform fee. FoilMarket charges the seller 5% of the item price (3% for Pro sellers); shipping charges are passed on in full. Stripe payment processing fees (~1.5% + €0.25) are additional and charged by Stripe directly. Fees are deducted before payout. Trading on the Trading Hub is free.

The platform fee is non-refundable. If an order is refunded, reversed or charged back for any reason (including a buyer's withdrawal, a dispute decision or a cancellation by the seller), the refund is funded from the seller's proceeds: the amount paid to the seller is reversed and returned to the buyer, while FoilMarket retains its platform fee. Stripe's processing fees are likewise not returned by Stripe. Sellers accept this when they list an item.

5. Seller status: private or business

Before you can publish a listing, FoilMarket asks you to declare whether you sell as a private individual or as a business (trader). We show that declaration to buyers on every listing, as required by Article 6a of the EU Consumer Rights Directive. You can change it at any time in Account settings, and you must keep it accurate.

You are a business seller if you sell in the course of a trade, business, craft or profession — for example selling regularly, in volume, or with the intention of making a profit. This is decided by what you actually do, not only by the box you tick: a seller who lists at high volume may qualify as a trader even without a registered company. If you are unsure, take advice.

Business sellers must provide a legal name and address (shown publicly on their listings), honour the 14-day right of withdrawal, and give the statutory 2-year guarantee (Gewährleistung). Depending on turnover, VAT may apply; the Austrian small-business exemption (Kleinunternehmer) may be available below the applicable threshold.

Private sellers are not subject to those rules. Buyers purchasing from a private seller have no statutory right of withdrawal and no statutory guarantee — we state this clearly on the listing and at checkout. FoilMarket's own buyer protection (item not received, or materially not as described) applies to every order regardless of seller status.

5a. EU consumer rights (Widerrufsrecht)

Where you buy from a business seller as a consumer, you may withdraw from the contract within 14 days of receiving the goods, without giving a reason. To do so, send an unambiguous statement to the seller (via Messages) or use the model withdrawal form below. The seller must refund you within 14 days of being informed. Return shipping costs are borne by the buyer unless the seller states otherwise.

6. Dispute resolution

Contact us at disputes@foilmarket.eu for help. We mediate but cannot compel outcomes in peer-to-peer disputes. Consumers retain all rights under applicable EU and Austrian consumer law.

7. Prohibited items

Counterfeit cards, proxy cards, cards graded higher than their actual condition, and any item not related to the Pokémon TCG are prohibited. Violations result in immediate account suspension.

8. Limitation of liability

FoilMarket acts solely as a venue connecting buyers and sellers. We are not a party to any transaction and do not guarantee the quality, safety, legality, or accuracy of listings. To the maximum extent permitted by Austrian and EU law:

• Our total liability to any user shall not exceed the fees collected from that user in the 12 months preceding the claim.
• We are not liable for indirect, incidental, or consequential damages including lost profits, lost data, or business interruption.
• We are not liable for losses arising from third-party services (Stripe, shipping carriers, etc.).

Nothing in these terms limits liability for fraud, gross negligence, or death/personal injury caused by our negligence, as required by Austrian law (ABGB).

9. Payments & payouts

All payments are processed by Stripe. When a buyer completes checkout, the payment is split: the item price minus the platform fee (5%, or 3% for Pro sellers) plus the full shipping charge goes to the seller's connected Stripe account, and the fee is retained by FoilMarket. Seller payouts are processed by Stripe within 2-3 business days. Payments are not held pending delivery unless otherwise stated. Refunds are issued through FoilMarket by reversing the seller's transfer; the platform fee retained by FoilMarket is not refunded (see §4).

10. Chargebacks & payment disputes

If a buyer initiates a chargeback through their bank or card issuer:

• Stripe may debit the disputed amount plus any chargeback fees (currently €15 per dispute) from the platform or the seller's connected account.
• FoilMarket will provide transaction records and shipping evidence to assist in contesting fraudulent chargebacks.
• Orders that ship tracked, parcel or insured carry proof of delivery, which significantly strengthens chargeback defence.
• Lower-value orders that ship by untracked economy letter carry no tracking, so the seller may not be able to prove delivery in a dispute.
• Repeated chargebacks (3+ in 6 months) may result in account suspension.

11. Account suspension & termination

We reserve the right to suspend or permanently terminate accounts for:

• Listing counterfeit or prohibited items
• Fraudulent transactions or chargeback abuse
• Repeated failure to ship items within the stated timeframe
• Harassment or abuse towards other users
• Violation of these Terms of Service

Upon suspension: active listings are removed, pending payouts are held for 90 days (or until disputes are resolved), and the user will be notified via email with the reason for suspension. Users may appeal by contacting disputes@foilmarket.eu within 30 days.

You may delete your account at any time. Outstanding orders and open trades must be completed or cancelled before deletion. Transaction records are retained for 7 years per Austrian commercial law.

12. Content moderation & Digital Services Act (DSA)

FoilMarket is an online platform under Regulation (EU) 2022/2065 (Digital Services Act). As a micro-enterprise, some DSA obligations do not apply to us, but the following do — and this is how we meet them:

• Point of contact (Art. 11–12 DSA): Our single point of contact for EU Member State authorities, the European Commission, and users is contact@foilmarket.eu. Communication is possible in English and German.
• Reporting illegal content (Art. 16 DSA): Anyone can report a listing, community post or user they consider illegal or in breach of these terms via the Report button on every listing, the ⚑ Report option on profiles, or by email to contact@foilmarket.eu with the listing link and the reason. Reports are reviewed by a human — we do not use automated decision-making to remove content.
• How we moderate: Listings, posts, comments, polls and trade offers may be removed and accounts suspended for the reasons set out in sections 7, 11 and 14 (counterfeits, prohibited items, fraud, abuse). Automated checks (e.g. digital-only card detection) may block a listing from being created, but removal decisions are made by our team.
• Statement of reasons (Art. 17 DSA): If we remove your listing or suspend your account, we notify you with the specific reason and the facts relied on.
• Appeals: You can contest any moderation decision within 30 days via disputes@foilmarket.eu. A different team member reviews appeals where possible.

13. Trading Hub (card-for-card trades)

A trade is an agreement between two members to exchange cards. No money is processed by FoilMarket and the marketplace buyer protection does not apply. FoilMarket records the offer, acceptance, shipping and receipt steps and publishes a trade reputation based on completed tracked trades. The Trading Hub is available for shipments within the EU.

• Cards must match what was offered: card, set, language, condition and, for slabs, the grade and certificate number.
• Ship within 3 business days of acceptance (or once it is your turn, where the trade sets who ships first), tracked, sleeved and in a top-loader, and enter the tracking number. Confirm receipt promptly and truthfully.
• Shipping addresses are shared only between the two parties and only after both have accepted. Use them for that trade only.
• A trade counts toward reputation only when it is tracked and both receipts are confirmed. Receipts confirmed less than 24 hours after shipping and a second trade with the same partner within 30 days do not count. The first 100 completed tracked trades earn the Founding Trader badge.
• Misrepresentation, non-shipment or false receipt confirmations lead to a negative trade record and may lead to suspension (section 11). For help with a trade, email disputes@foilmarket.eu with the tracking details; we mediate but cannot compel outcomes.

14. Community, Wants and your content

Posts, comments, polls, pull photos, trade offers, listing photos, bios and avatars are your content. You grant FoilMarket a non-exclusive, worldwide, royalty-free licence to display and distribute it on the platform and in previews of it (for example link previews and the automatic announcement of new listings in FoilMarket's public Discord) for as long as it is on the site.

• Be respectful. Harassment, hate speech, spam, promotion of counterfeits, requests to pay outside the platform, posting other people's personal data and content unrelated to the hobby are not allowed. Announcements are reserved for the FoilMarket team.
• A Want you mark as visible to traders is shown to other members together with your username so they can offer that card. Price alerts for Wants are sent by email according to your notification settings.
• Weekly showcase challenges and FoilGuess are free promotional games. The monthly FoilGuess winner (most solves in the calendar month; ties and edge cases are decided by FoilMarket) receives one month of Pro Seller as a redeemable code. No cash alternative; accounts operated by FoilMarket are not eligible.

15. Price data and tools

Market prices, collection values, FoilValue box values and FoilGuess reference prices are estimates derived from third-party market data: US market data (TCGplayer via Scrydex, converted to EUR at daily exchange rates) and, where a card page says so, Cardmarket's published price guide (Cardmarket trend, EUR; price data: Cardmarket). Each price shows which source it comes from. They are informational only, can lag the market and are not financial, investment or valuation advice. Sellers set their own prices.

16. Governing law

These terms are governed by Austrian law. Disputes are subject to the jurisdiction of Austrian courts in Vienna, except where mandatory EU consumer law provides otherwise.

Cookie Policy

Essential cookies (no consent required)

• Supabase auth token (sb-…-auth-token, localStorage): Keeps you logged in until you log out or the session expires.
• fm-cookie: Remembers your cookie preference. Expires after 1 year.
• Stripe (__stripe_mid, __stripe_sid): Set by Stripe.js for fraud prevention on pages that load the payment library; needed for secure checkout.
• Local preferences and caches (localStorage, not cookies): theme, language, layout choices, drafts of trade posts and listings, a cache of your collection and listings that is synced with your account, an image-URL cache and FoilGuess streaks for guests. Stored only in your browser; cleared when you clear site data.

Optional analytics cookies (requires consent)

If you accept cookies, we use Google Analytics 4 (with Consent Mode v2) to understand anonymous page traffic — which pages are visited and how often. Until you accept, analytics runs in cookieless, consent-denied mode and sets no analytics cookies. You can withdraw consent at any time below.

We do NOT use

• Advertising/tracking cookies
• Third-party social media pixels
• Cross-site tracking or remarketing of any kind

Card Condition Grading Guide

Graded (slabbed) cards

Cards graded by PSA, BGS, CGC, TAG, ACE, SGC and similar services are listed as graded: choose the company, enter the grade (half grades where the company uses them) and the certificate number. The grade is shown in place of a condition, buyers can verify the certificate with the grader, and graded sales are kept out of raw-card price estimates. Cracked, re-holdered or damaged slabs must be described as such.

Buyer Protection

How it works

• Secure payments: All payments are processed via Stripe. Your card details are never stored on our servers.
• Item not received: If your item doesn't arrive within 14 days (EU) or 21 days (international), open a dispute and we'll investigate with the seller.
• Item not as described: If the card condition doesn't match the listing (e.g., listed as NM but arrives PL), you can open a dispute within 14 days of delivery.
• Counterfeit protection: If you receive a counterfeit card, you are entitled to a full refund. The seller's account will be suspended.
• Graded cards: The slab, grade and certificate number must match the listing. A mismatch counts as "not as described".
• Seller ratings: After confirming delivery, you can rate the seller (1-5 stars). Ratings help the community identify trustworthy sellers.

Shipping

FoilMarket automatically selects the right shipping tier for every order based on its value and contents — sellers set their rates, and the right one is picked for you:

• Economy letter: low-cost untracked mail, used only for lower-value single-card orders.
• Tracked letter: automatically applied once an order's value passes the seller's tracking threshold. A tracking number serves as proof of delivery in a dispute.
• Parcel: used for sealed products, shipped tracked.
• Insured parcel: automatically applied to very high-value orders, with declared-value insurance.

Because higher-value orders always ship tracked — and insured above the seller's insurance threshold — you're protected on the orders that matter most. On lower-value orders you can optionally add tracking at checkout for extra peace of mind.

Payment processing

Payments are processed immediately via Stripe at checkout. The seller receives their payout within 2-3 business days via Stripe Connect. If you experience an issue with your order, you can:

• Contact the seller directly via Messages
• Email disputes@foilmarket.eu with your order details and photos
• As a last resort, initiate a chargeback through your bank or card issuer

What's not covered

• Buyer's remorse (changed your mind)
• Price changes after purchase
• Minor condition disagreements within one grade (e.g., "I think it's NM not LP")
• Card-for-card trades on the Trading Hub — no payment is processed, so buyer protection does not apply (see Terms of Service, section 13)
• Loss in transit of a lower-value order shipped by untracked economy letter where tracking was not added — this lowest-cost tier carries no tracking, so delivery cannot be proven

Dispute Resolution

Step 1: Contact the seller

Use the Messages feature to contact the seller directly. Most issues can be resolved with a quick conversation.

Step 2: Open a dispute

If you can't resolve it directly, email disputes@foilmarket.eu with: your username, the listing ID, a description of the issue, and photos if applicable.

Step 3: Mediation

Our team will review the case within 48 hours and propose a resolution. We may ask both parties for additional information.

Step 4: Resolution

Possible outcomes include: full refund, partial refund, return & refund, or case dismissed. Both parties will be notified of the decision.

Consumer dispute resolution

We aim to resolve every dispute directly via the steps above. Consumers keep all their rights under EU and Austrian consumer law — nothing here limits them. (The EU's Online Dispute Resolution platform was discontinued by the European Commission in July 2025 and is no longer available.)
