Data we collect

• Account data: Email address, username, country (required to create an account)
• Listing data: Card details, prices, descriptions you submit
• Transaction data: Purchase/sale records, shipping method chosen, buyer ratings. Payment info is handled by Stripe (they are the data processor — we never see card numbers)
• Technical data: IP address, browser type (in server logs, auto-deleted after 30 days)
• Communications: Messages between buyers and sellers via our platform

Legal basis (GDPR Art. 6)

• Contract performance (Art. 6.1.b): account, listings, transactions
• Legitimate interest (Art. 6.1.f): security, fraud prevention, server logs
• Consent (Art. 6.1.a): analytics cookies, if you accept them

Your rights

Under GDPR you have the right to: access your data, correct inaccurate data, delete your account and data, export your data (portability), restrict processing, and object to processing. Email privacy@foilmarket.eu to exercise these rights. We respond within 30 days.

Data retention

Account data: retained while your account is active + 30 days after deletion. Transaction records: 7 years (Austrian commercial law requirement, UGB §212). Messages: 2 years.

Third parties

• Supabase (EU servers): Database and authentication. GDPR DPA in place.
• Stripe: Payment processing. Their privacy policy applies to payment data.
• Hostinger: Web hosting. EU servers used.

Terms of Service

1. Platform description

FoilMarket.eu is a peer-to-peer marketplace for Pokémon TCG cards. We connect buyers and sellers; we are not a party to individual transactions between users.

2. Account requirements

You must be 18 or older (or 16 with parental consent under Austrian law). One account per person. You are responsible for your account security.

3. Seller obligations

• Cards must be accurately described and graded honestly
• Condition must match: NM = no visible wear, LP = minor edge wear only, PL = clear play wear
• Ship within 3 business days of payment confirmation
• Sellers must offer at least one shipping option (tracked or untracked) and set a fair shipping price
• If tracked shipping is selected by the buyer, the seller must provide a valid tracking number
• Prohibited: counterfeits, proxy cards, damaged cards listed as NM, items not matching photos

4. Fees

Listing is free. FoilMarket charges 5% of the final sale price (3% for Pro sellers). Stripe payment processing fees (~1.5% + €0.25) are additional and charged by Stripe directly. Fees are deducted before payout.

5. EU consumer rights (Widerrufsrecht)

Private sellers (non-commercial) are not required to accept returns under EU consumer law. Commercial sellers must comply with the 14-day right of withdrawal. Clearly indicate in your listing whether you are a commercial or private seller.

6. Dispute resolution

Contact us at disputes@foilmarket.eu for help. We mediate but cannot compel outcomes in peer-to-peer disputes. Escalation to EU ODR platform is available.

7. Prohibited items

Counterfeit cards, proxy cards, cards graded higher than their actual condition, and any item not related to the Pokémon TCG are prohibited. Violations result in immediate account suspension.

8. Limitation of liability

FoilMarket acts solely as a venue connecting buyers and sellers. We are not a party to any transaction and do not guarantee the quality, safety, legality, or accuracy of listings. To the maximum extent permitted by Austrian and EU law:

• Our total liability to any user shall not exceed the fees collected from that user in the 12 months preceding the claim.
• We are not liable for indirect, incidental, or consequential damages including lost profits, lost data, or business interruption.
• We are not liable for losses arising from third-party services (Stripe, shipping carriers, etc.).

Nothing in these terms limits liability for fraud, gross negligence, or death/personal injury caused by our negligence, as required by Austrian law (ABGB).

9. Payments & payouts

All payments are processed by Stripe. When a buyer completes checkout, the payment is split: 95% of the item price plus shipping goes to the seller's connected Stripe account, and 5% is retained as the platform fee. Seller payouts are processed by Stripe within 2-3 business days. Payments are not held pending delivery unless otherwise stated.

10. Chargebacks & payment disputes

If a buyer initiates a chargeback through their bank or card issuer:

• Stripe may debit the disputed amount plus any chargeback fees (currently €15 per dispute) from the platform or the seller's connected account.
• FoilMarket will provide transaction records and shipping evidence to assist in contesting fraudulent chargebacks.
• Sellers who choose tracked shipping benefit from proof of delivery, which significantly strengthens chargeback defence.
• Sellers who use untracked shipping accept the risk that they may not be able to prove delivery in a dispute.
• Repeated chargebacks (3+ in 6 months) may result in account suspension.

11. Account suspension & termination

We reserve the right to suspend or permanently terminate accounts for:

• Listing counterfeit or prohibited items
• Fraudulent transactions or chargeback abuse
• Repeated failure to ship items within the stated timeframe
• Harassment or abuse towards other users
• Violation of these Terms of Service

Upon suspension: active listings are removed, pending payouts are held for 90 days (or until disputes are resolved), and the user will be notified via email with the reason for suspension. Users may appeal by contacting disputes@foilmarket.eu within 30 days.

You may delete your account at any time. Outstanding transactions must be completed or cancelled before deletion. Transaction records are retained for 7 years per Austrian commercial law.

12. Governing law

These terms are governed by Austrian law. Disputes are subject to the jurisdiction of Austrian courts in Vienna, except where mandatory EU consumer law provides otherwise.

Cookie Policy

Essential cookies (no consent required)

• sb-auth-token: Keeps you logged in. Session cookie, expires when you close your browser or after 7 days.
• fm-cookie: Remembers your cookie preference. Expires after 1 year.
• fm-vault / fm-listings: Stores your local collection data in localStorage (not a cookie, but similar). Never sent to servers.

Optional analytics cookies (requires consent)

If you accept cookies, we may use privacy-focused analytics (e.g. Plausible Analytics — no personal data, no cross-site tracking, no fingerprinting, EU-hosted) to understand page traffic. You can withdraw consent at any time below.

We do NOT use

• Advertising/tracking cookies
• Third-party social media pixels
• Any cookies from Google, Meta, or similar

Card Condition Grading Guide

NM — Near Mint

Card looks brand new or almost new. No visible wear, no scratches on the surface, no whitening on edges or corners. Minor factory imperfections are acceptable. This is the expected condition for cards pulled straight from packs.

LP — Lightly Played

Minor edge wear or very slight whitening on corners. May have one or two very light surface scratches only visible at an angle. Card looks great in a sleeve. Most collectors consider LP cards acceptable for binders.

PL — Played

Noticeable wear on edges and corners. Surface scratches visible without close inspection. May have minor creasing or slight bending. Card has been played without sleeves or handled frequently.

HP — Heavy Played

Significant wear across the card. Visible creases, heavy whitening on edges, noticeable surface damage. Card is still complete and identifiable but shows extensive play use.

DMG — Damaged

Card has major damage: tears, water damage, heavy creasing, missing pieces, or writing on the surface. Only suitable for casual collectors or as placeholder cards.

Buyer Protection

How it works

• Secure payments: All payments are processed via Stripe. Your card details are never stored on our servers.
• Item not received: If your item doesn't arrive within 14 days (EU) or 21 days (international), open a dispute and we'll investigate with the seller.
• Item not as described: If the card condition doesn't match the listing (e.g., listed as NM but arrives PL), you can open a dispute within 48 hours of delivery.
• Counterfeit protection: If you receive a counterfeit card, you are entitled to a full refund. The seller's account will be suspended.
• Seller ratings: After confirming delivery, you can rate the seller (1-5 stars). Ratings help the community identify trustworthy sellers.

Shipping options

Sellers can offer tracked shipping, untracked shipping, or both. When purchasing, you choose the shipping method. Important:

• Tracked shipping: The seller provides a tracking number. In case of a dispute, tracking serves as proof of delivery.
• Untracked shipping: Lower cost but no tracking. If the item is lost in transit, proving delivery is difficult. FoilMarket recommends tracked shipping for items over €20.

Payment processing

Payments are processed immediately via Stripe at checkout. The seller receives their payout within 2-3 business days via Stripe Connect. If you experience an issue with your order, you can:

• Contact the seller directly via Messages
• Email disputes@foilmarket.eu with your order details and photos
• As a last resort, initiate a chargeback through your bank or card issuer

What's not covered

• Buyer's remorse (changed your mind)
• Price changes after purchase
• Minor condition disagreements within one grade (e.g., "I think it's NM not LP")
• Items lost during untracked shipping where the buyer chose untracked over available tracked option

Dispute Resolution

Step 1: Contact the seller

Use the Messages feature to contact the seller directly. Most issues can be resolved with a quick conversation.

Step 2: Open a dispute

If you can't resolve it directly, email disputes@foilmarket.eu with: your username, the listing ID, a description of the issue, and photos if applicable.

Step 3: Mediation

Our team will review the case within 48 hours and propose a resolution. We may ask both parties for additional information.

Step 4: Resolution

Possible outcomes include: full refund, partial refund, return & refund, or case dismissed. Both parties will be notified of the decision.

EU ODR Platform

As an EU-based platform, you can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Requirements

• Minimum 50 completed sales
• Rating of 4.7 or higher
• Account in good standing (no unresolved disputes)
